I wrote a Terms of Service and a Disclaimer; if you wish to use it.
The Disclaimer should be placed on the page before the homepage on http://hypnoticstory.no-ip.org;
Whereas the TOS should be placed in the forums as the ONLY thing guests are allowed to read and also before registering.

HypnoticStory Terms Of Service.

By using or browsing the sites:
a) www.hypnoticstory.forumotion.com
b) http://hypnoticstory.no-ip.org/
You hereby agree to the following Terms & Conditions.

1. Acceptance of Terms of Service.
By accepting you agree and are bound to the terms and conditions set by the administrative board of all HypnoticStory related websites. The administration reserves the right to update and change the Terms of Service without prior knowledge or acceptance on your part. You also agree to application of the terms in any HypnoticStory related activity. By use of the service provided, irrevocable acceptance on your part shall be noted. If and when you do break any of the terms, you are subject to penalty or punishment seen fit by the administration.

2. Description of Service.
HypnoticStory is a privately run version of the MMORPG MapleStory owned by Nexon and developed by Wizet. All third party content found in HypnoticStory and its sites will be copyrighted to the stated owners. Donation is not required but welcomed. Further explanation will be down below regarding donation.

HypnoticStory is free for everyone except for those otherwise stated. By agreeing to the terms you agree that you have voluntarily chosen to use the services provided by HypnoticStory and its affiliated sites.

3. Restricted Personnel.
Anyone who is affiliated to the following are hereby banned from using this service. By agreeing to the terms you claim that you are not part of the following or related and you can be punished if found otherwise.

[i] Nexon & Affiliated;
[ii] Wizet & Affiliated;
[iii] Asiasoft & Affiliated.

You also hereby agree to not inform the above parties of any activities related to HypnoticStory and its sites. You agree to not disclose information regarding HypnoticStory to any possible harmful parties.

4. Registration.
In order to use the services provided by HypnoticStory you will be asked to register. All information you provide upon registration must be true and verified. Upon registration you will be asked to set a username and password. You are responsible for maintaining the confidentiality of your username and password as well as the activities that occur under the username and password. HypnoticStory does not take responsibility for any leak of the username and password or the activities that occur and are linked to the username. You agree to (a) inform the administration if any unauthorized use of your username and password occur or breach in security; (b) keep the information you gain from membership to yourself; (c) only use the account for private conduct; and (d) log off after every session. HypnoticStory will not be liable for any loss or damage if you fail to comply with the above terms.

When you register you hereby agree to (a) provide true, accurate, current and complete information that is asked for; and (b) update the information you provided if it changes. If you fail to do so the administration has the right to suspend, ban or delete your account as well as your IP from further involvement in HypnoticStory activities.

4. Change in Service.
HypnoticStory administrators reserve the rights to change, update, remove or delete the services they provide without prior notice or approval on your part. HypnoticStory is not responsible for any loss or damage incurred with the said change. The administrators reserve the right to terminate their services with valid reason and will not be liable for any losses in information or content.

5. Termination of Membership.
You hereby agree to lose all rights of participation in HypnoticStory activities if and when you terminate your membership. The administration takes no responsibility in retrieving any loss information from termination and will not restore your account if and when you decide to rejoin.

You also agree that the administrators, at their discretion, are allowed to remove or delete any information affiliated to your account once you have severed ties with HypnoticStory.

HypnoticStory reserves the right to terminate your membership if and when you do not comply fully with the terms of service or the rules and regulations as required by the administrators. Prior notice will not be given. The administrators are not liable for any loss in information or damages resulted from this termination. The rights to allow access to any HypnoticStory related activity lies solely in its administrators and you hereby agree to this.

6. Ownership.
By agreeing to this you are responsible for all activities conducted under your account and are responsible to take action if and when any unauthorized use of your account incurs. The administrators do not claim liability if any breaches of security occur. You also agree to accept punishment if activities under your account have been found to be violations of the rules and regulations of HynoticStory. The administrators reserves the right to take over ownership of your account with valid reason without prior approval on your part.

7. Content and Conduct.
You understand that all information, data, text, sound, music, graphics, videos, messages, goods, products or other material are the sole responsibility of the person it originated from. HypnoticStory does not guarantee accuracy, integrity or quality of the content found on its sites and will not take responsibility for it.

You understand that you may be exposed to content that is objectionable, offensive or indecent. Under no circumstances is HypnoticStory, its developers or its administrators liable for exposure to such content or loss/damage that occurs. You acknowledge that the content posted may be removed or deleted by the administrators at their discretion without prior notice. HypnoticStory and its designees have the right to remove content found in violation of the TOS or R&R.

Should content be found or reported to be in violation with, but not limited to, the following terms, it will be in the administrators's sole discretion as to what action should be taken.
You agree that you will not:
(a) Upload, post, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;

(b) Harm minors in any way;

(c) Impersonate any person or entity, including, but not limited to, a HypnoticStory administrator, staff, member, or falsely state or otherwise misrepresent your affiliation with a person or entity;

(d) Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through your account;

(e) Upload, post or otherwise transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

(f) Upload, post or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary rights of any party;

(g) Upload, post, or transmit unsolicited commercial email or "spam". This includes unethical marketing, advertising, or any other practice that is in any way connected with "spam", such as (a) sending mass email to recipients who haven't requested email from you or with a fake return address, (b) promoting a site with inappropriate links, titles, descriptions, or (c) promoting your site by posting multiple submissions in public forums that are identical;
(h) Upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

(i) Interfere with or disrupt the service or servers or networks connected to HypnoticStory, or disobey any requirements, procedures, policies or regulations of networks connected to the HypnoticStory;

(j) Intentionally or unintentionally violate any applicable local, state, national or international law;

(k) "Stalk" or otherwise harass another;

(l) Promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty. This may include, without limitation, providing instructions on how to hurt, harm, damage or create damage for another.

(m) exceed the scope of the service that you have signed up for; for example, accessing and using the tools that you do not have a right to use, or deleting, adding to, or otherwise changing other peoples comments or content as a Guest. If any user is reported to be in violation with the letter or spirit of these terms, HypnoticStory retains the right to terminate such account at any time without further warning.

8. Donation Terms.
You agree that you have informed regarding the terms of donation that follows:

(a) You have donated on your own free will without involvement on the administrator's part;
(b) You will not ask for any refunds once the transaction is complete;
(c) You will not request for special privileges in conjunction with your donation unless offered by the administrators.

9. Additional Software.
You promise to not run any additional software during the course of running the HypnoticStory server that would affect the game play in any way. You will not use any additional software to gain unauthorized privilege to any sites or aspects of the service not allowed by the administrators. You will not use additional software to track or retrieve information about others or change your IP.

10. Limitation on Liability.
In no way is HypnoticStory, its developers or its administrators liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including without limitation, losses or damages arising from your use of the HypnoticStory services or linked services.

11. Staff.
The staff of HypnoticStory has the right to use their powers or special rights in the services provided by HypnoticStory to carry out their duties and work. You agree to the following terms:

(a) Respect the staff of HypnoticStory;
(b) Do not disrupt them as they carry out their job;
(c) Do not harass or provide unwanted attention to them;
(d) Do not threaten to harm or actually harm them in any way;
(e) Do not curse or incur verbal abuse upon them.

You also agree to accept punishments or decisions carried out by the staff of HypnoticStory without objections.

12. IP.
You acknowledge the right of HypnoticStory and its administrators to track your IP or information you have provided. You have also acknowledge the right of HypnoticStory to ban your IP from further services provided by HypnoticStory if you have been found to violate the TOS and R&R in any way.

The Terms of Service is further affirmed upon your subscription of membership. This provides the administrators full rights to hold you to the TOS and R&R. This agreement will be operated to the fullest extent permissible by law. The administrators of HypnoticStory has every right to add, remove, delete or change any information or terms in the TOS if it is deemed void, unlawful or unenforceable.

Disclaimer

HypnoticStory is a privately run server without any affiliation to Nexon, Wizet, Asiasoft, N-Security or any other parties.

By viewing the websites linked to HypnoticStory you hereby agree (a) to not disclose information or content found within to any of the above mentioned parties; and (b) you are not in any way related or affiliated to Nexon, Wizet, Asiasoft, N-Security or any of its affiliations.

All materials found are copyrighted to their respective stated owners.

Content found within HypnoticStory and its sites may be objectionable to certain parties and thus you are forewarned that HypnoticStory and its administrators do not claim responsibility for any harmful content found.

Information on the sites are subject to removal, addition, deletion or changes as seen fit by the administrators of HypnoticStory without prior notice or approval on your part.

You agree to follow the TOS and R&R of HypnoticStory the moment you click the 'Agree' button. If you do not wish to agree, please leave this page immediately.
